Terms of Service
These terms govern your use of AutoGuideCover. They include an agreement to arbitrate disputes individually and a waiver of class actions.
Please read section 13 carefully. It requires most disputes to be resolved through binding individual arbitration rather than in court, and it waives your right to participate in a class action. You may opt out within 30 days.
Agreement
These Terms of Service ("Terms") are a contract between you and AutoGuideCover ("AutoGuideCover," "we," "us" or "our"). They apply to your use of autoguidecover.com and all related pages, forms, content and communications (the "Services"). By using the Services or submitting information through them, you accept these Terms and our Privacy Policy. If you do not accept them, do not use the Services.
Who may use the Services
The Services are intended for individuals who are at least 18 years old and live in the United States. By using them, you confirm that you meet these requirements and that you can form a binding contract.
What we do, and what we don't
AutoGuideCover is a free referral and marketing service. When you submit a request, we may share your information with insurance carriers, licensed agents and brokers, and marketing companies that work with them ("Partners"), who may contact you about insurance.
- We are not an insurance company, agency, broker or producer, and we do not sell, solicit, negotiate or bind insurance.
- We do not provide quotes, set prices, decide eligibility or handle claims. Partners make those decisions.
- We do not promise that any Partner will contact you, that you will qualify for coverage, or that any offer will cost less than what you pay now.
- We do not represent every insurer, and not every product, coverage or discount is available everywhere.
- The Services are free to you. Partners may pay us, and that may affect which Partners receive your request.
Information only, not advice
Guides, coverage explanations, rate factors, checklists and answers on the Services are general information. They are not insurance, legal, tax or financial advice, may not reflect the law or practice in your state, and may be out of date. Talk to a licensed professional and read any policy carefully, including its exclusions, before you buy.
Your submissions
You agree to provide information that is accurate, current and complete, and that relates to you. You may not submit another person's information, use a fake identity or submit information to receive communications intended for someone else.
You authorize us to share your submission with Partners and service providers as described in our Privacy Policy. You also authorize Partners to verify your information and to obtain consumer reports permitted by law, such as motor vehicle records, claims history and, where allowed, credit-based insurance scores, in order to prepare a quote.
Calls, texts and electronic records
If you check the consent box on our form, you agree to be contacted as described on our Communications Consent page, which forms part of these Terms. Consent is not required to purchase anything. You confirm that you are the subscriber or regular user of the phone number you provide and will tell us if it changes.
You agree that we may provide notices, disclosures and records electronically and that your electronic agreement has the same effect as a handwritten signature.
Prohibited conduct
When using the Services, you will not:
- break any law or use the Services for fraud, deception or harassment;
- submit false information or information about someone else without permission;
- use scripts, bots, scrapers or other automated tools to access the Services or submit forms;
- probe, scan or test the vulnerability of the Services, or bypass any security measure;
- upload malicious code or interfere with the operation of the Services;
- copy, frame or resell any part of the Services without our written permission.
We may refuse, suspend or end your access at any time if we believe you have violated these Terms.
Ownership
We or our licensors own the Services and everything on them, including text, graphics, illustrations, logos, software and design, which are protected by intellectual property laws. "AutoGuideCover" and our logo are our trademarks. We give you a personal, limited, revocable, non-transferable license to view and use the Services for their intended purpose. All other rights are reserved.
Third parties
We do not control Partners or other third parties, and we are not responsible for their products, services, advice, quotes, websites or conduct. Any agreement you make with a Partner is between you and that Partner.
Disclaimers
The Services are provided "as is" and "as available." To the maximum extent allowed by law, AutoGuideCover disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, title and non-infringement. We do not warrant that the Services will be uninterrupted, error-free or secure, or that you will receive any quote, coverage, rate or savings.
Limits on liability
To the maximum extent allowed by law, AutoGuideCover and its owners, employees, contractors and Partners will not be liable for any indirect, incidental, consequential, special, exemplary or punitive damages, or for lost profits, revenue, data or goodwill, arising from or related to the Services or any Partner's products or services, however caused and under any theory of liability. Our total liability for any claim relating to the Services will not exceed one hundred dollars ($100).
Some states do not allow these limitations, so they may not fully apply to you.
Indemnity
You will defend, indemnify and hold harmless AutoGuideCover and its owners, employees and contractors from any claims, losses, damages, liabilities, costs and expenses, including reasonable attorneys' fees, arising from your use of the Services, your submissions, your violation of these Terms or your violation of the rights of others.
Disputes and arbitration
Talk to us first
If you have a dispute with us, email [email protected] with your name, contact information and a description of the issue. Both sides agree to try to resolve it informally for 30 days before starting arbitration.
Arbitration
Any dispute, claim or controversy between you and AutoGuideCover relating to the Services, these Terms or any communication you received from us or on our behalf, including claims under the Telephone Consumer Protection Act and state telemarketing laws, will be resolved by final, binding arbitration on an individual basis. Arbitration will be administered by JAMS under its Streamlined Arbitration Rules and Procedures (or, if JAMS is unavailable, by another mutually agreed provider). The Federal Arbitration Act governs this section. The arbitrator decides all questions about whether a dispute must be arbitrated. Either party may instead bring an individual claim in small claims court.
No class actions
You and AutoGuideCover may bring claims only in an individual capacity, not as a plaintiff or class member in any class, collective or representative action. The arbitrator may not combine claims of different people or award relief on a class-wide basis.
Opting out
You can reject this arbitration agreement by mailing or emailing a signed notice to AutoGuideCover, 4820 Westpark Drive, Suite 210, Columbus, OH 43228, or [email protected], within 30 days after you first use the Services. Include your name, address, phone number and email and state that you are opting out of arbitration.
Governing law
These Terms are governed by the laws of the State of Ohio, without regard to conflict-of-law rules, and by the Federal Arbitration Act as to arbitration. Any dispute not subject to arbitration will be heard only in the state or federal courts located in Franklin County, Ohio, and both parties consent to that jurisdiction.
Changes
We may update these Terms by posting a revised version with a new "Last revised" date. Updates apply from the date posted, and your continued use of the Services means you accept them. Changes will not apply to disputes we already knew about.
Miscellaneous
These Terms and the policies they reference are the entire agreement between you and us about the Services. If a provision is unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not transfer these Terms; we may. We are not responsible for delays or failures caused by events outside our reasonable control.
